The petitioners in the present case are seeking prearrest bail in connection with Nautan P.S. Case No.22 of 2021 registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

As per the First Information Report, the allegation against the petitioners is of kidnapping of the minor daughter of the informant aged about 16 years.

Learned counsel for the petitioners submits the petitioners are innocent and have been falsely implicated in this case. Learned counsel submits that the victim girl in her

Patna High Court CR. MISC. No.41441 of 2021(2) dt.21-03-2022 2/2 statement under Section 164 Cr.P.C. has stated that she has love affair with co-accused Abhimanu and she has solemnized marriage with him at temple in Chapra on 25.02.2021. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent as stated in paragraph '3' of the application. Learned APP for the State is present and has opposed the prayer for bail.

Considering the fact that there is no specific overt act against the petitioners, let the petitioners above-named in the event of their arrest or surrender within a period of six weeks from today in connection with Nautan P.S. Case No.22 of 2021 be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
