Petitioner apprehends his arrest in Complaint Case No.09 of 2016 instituted for the offence under Section(s) 420 Indian Penal Code and Section 138 of the Negotiable Instrument Act pending in the Court of the Chief Judicial Magistrate, Jehanabad.
Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court by order dated 25.06.2018 passed in Cr. Misc. No.15503 of 2018.
This Court finds that prayer of the petitioner was earlier rejected on merit.
Patna High Court Cr.Misc. No.58431 of 2018 (2) dt.26-09-2018 2/2 This Court does not find any fresh ground to entertain this second anticipatory bail application. This application is, accordingly, dismissed.
Counsel for the petitioner submits that he is ready to return the amount of cheque to the Complainant. In the event, the petitioner surrenders in the Court below within four weeks from the date of receipt of this order and submits that he is ready to return the amount of cheque to the Complainant and the Complainant becomes ready to accept the same, the Court below will consider the prayer of the petitioner for grant of bail and pass appropriate order in accordance with law, preferably on the same day, without being prejudiced by this order.
