The petitioner apprehends his arrest in connection with Madanpur P.S. Case No.157 of 2023 registered under Sections 30(a), 34 and 36 of the Bihar Prohibition and Excise (Amendment) Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Nothing has been recovered from possession of the petitioner rather recovery of illicit spirit has been made from open place i.e. Palakiya Bridge.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of

No.31955 of 2023(2) dt.21-07-2023 2/2 arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Court No.01, Aurangabad, Bihar in connection with Madanpur P.S. Case No.157 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
