JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2018 This revision application has been preferred against the interim maintenance order of Rs.3,500/- in favour of O.P.No.2. Submission of the learned counsel for the petitioner is that income of the petitioner has not been assessed and the interim order has been passed against the petitioner and further O.P.no.2 is also earning under MGNREGA Scheme but the learned court below has not considered the same.

Heard learned A.P.P. and the learned counsel for the O.P.NO.2.

To my opinion, the learned court below has passed the interim order of maintenance, as such the petitioner has to appear before the learned court below and contest the maintenance case

Patna High Court CR. REV. No.480 of 2015 (3) dt.04-09-2018 2/2 and may pray for modification of order of interim maintenance, if he so desires.
