Though cognizance of an offence punishable under Section 307/ 34 of the I.P.C. has been taken against accused including the petitioner, but the materials having collected during course of investigation found only against accused Pramod Prasad and Ram Chandra Prasad coupled with the fact that the manner whereunder presence of petitioner has been shown by the informant also appears to be suspicious, whereupon, it happens to be a fit case wherein the learned lower Court would consider favourably after surrender of the petitioner for the purpose of granting of bail.
