The petitioner apprehends his arrest in Complaint case No. 2013 of 2017 registered under Section 406, 323, 504/34 of the IPC and u/s 138 of N.I. Act.
The complainant is brother of husband of petitioner. The complainant alleged in the complaint petition that husband of petitioner took the complainant and his younger brother to Lonawala for working in his fabrication shop on assurance that 50% of profit shall be divided among two brothers but the complainant and his younger brother was paid only Rs. Four lacs.
The learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.31682 of 2019(2) dt.13-05-2019 2/2 dispute is with regard to rendition of accounts and profit. The petitioner is wife of Indradeo Sharma. In the entire complaint petition no allegation is made against the petitioner. Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Samastipur in connection with Complaint case No. 2013 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
