The petitioner apprehends her arrest in connection with Kako P.S. Case no. 152 of 2017 registered under Sections 468, 409 and 420/34 of the Indian Penal Code. Petitioner is said to be Mukhiya of Kako West Panchayat. She along with Yogendra Paswan who happens to be Panchayat Secretary of the said Panchayat and Dilip Kumar Gupta has defalcated the advance money of Rs. 17,62,921/- for the financial year 2005-06 to 2009-10 and did not get the aforesaid account audited.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent. She has committed no offence. She has been falsely implicated in the case. Citing bail
Patna High Court Cr.Misc. No.53475 of 2018(2) dt.12-12-2018 2/2 order dated 19.02.2018 passed in Cr. Misc. No. 6705 of 2018 pertaining to Panchayat Secretary of the said Panchayat namely Yogendra Paswan, petitioner has also submitted that proper audit of the account of the said panchayat for the aforesaid financial year has already been done and no irregularity has been found by the auditor in the accounts and said Yogendra Paswan has been enlarged on Anticipatory Bail by a coordinate Bench of this Court. Case of the petitioner is on similar footing and she happens to be lady.
In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jehanabad in connection with Kako P.S. Case No. 152 of 2017, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
