JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-01-2021 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in Jandaha Police Station Case No. 230/2018 registered for the offence punishable under Section 392 of the Indian Penal Code.

Prosecution's case in brief is that four persons on two motorcycles without number plate surrounded the informant and on pistol point snatched his motorcycle, cash and other belongings and fled away. In the meantime, people chased and caught one Manish Kumar Singh who disclosed the name of the petitioner and other accused persons as his associates. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He submits that save and except confessional statement of co-accused, no incriminating material has been recovered from the conscious

Learned counsel for the State opposes the prayer for bail. He submits that the petitioner has criminal antecedent and as per supervision note mentioned in paragraph 96 of the case diary, case against the petitioner has been found to be true. Considering the nature of allegation against the petitioner and his criminal antecedent, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
