The petitioner apprehends his arrest in connection with Sonbarsa P.S. Case no. 96 of 2012, registered under Sections 406, 379/34 of the Indian Penal Code. The accusation is that a government hand pump was established near the house of Sumitra Devi, which was being used by the mohalla people. On 20.05.2012 Rupan Raut his wife Sarda Devi and sons Santosh Kumar and Bashant Kumar with the help of this petitioner started to dismental the government hand pump, when informant made protest then they started abusing and tried to assault her. Thereafter, informant gave the information to the Ward member and Mukhiya, but no action

Learned counsel for the petitioner submits that the government hand pump has not been recovered from the house of the petitioner. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 96 of 2012, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
