2. The petitioner has prayed for bail in connection with Vaishali (Belsar O.P.) P.S. Case No. 399 of 2023 registered for the offence punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.
3. The case of the prosecution is that the daughter of the informant was kidnapped by the petitioner and others for the purpose of marriage.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

It has further been submitted that the petitioner was having affair with the daughter of the informant and she has left the house with her own will. During course of investigation, the victim was recovered and she has given her statement under Section 164 of the Cr.P.C. which is apparent from the order of the trial court wherein she has stated that when she went to ease herself Shashi Bhusan Singh gagged her mouth and boarded her in a vehicle and there were two ladies in the vehicle. She was left with Ajay Kumar on a secluded place. From this statement also it transpires that the petitioner was having no role in kidnapping of the daughter of the informant.
It has also been submitted that Shashi Bhushan Singh has been granted bail by learned Co-ordinate Bench of this Court vide order dated 18.09.2024 in Cr. Misc. No. 64473 of 2024. The case of this petitioner stands on better footing. It has also been submitted that parties have compromised the case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 16.06.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and
Patna High Court CR. MISC. No.31210 of 2025(2) dt.20-05-2025 3/3 considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Vaishali at Hajipur in connection with Vaishali (Belsar O.P.) P.S. Case No. 399 of 2023.
