The petitioner is apprehending his arrest in connection with Bhagwan Bazar P.S.Case no.78 of 2018 registered for offences punishable under Sections 341, 323, 324, 307, 302, 114, 504/34 of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the petitioner caught hold of the hands of the deceased and another accused person has stabbed him.

Submission of the learned counsel for the petitioner is that he is not an assailant and he has no criminal antecedent. Heard learned A.P.P. also, who has opposed the prayer for bail stating that the petitioner has actively participated in the occurrence.

Patna High Court Cr.Misc. No.51288 of 2018 (2) dt.14-09-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below , if possible to be disposed of on the same day.. With the aforesaid observation, this application is dismissed.
