Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 05-03-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Khizersarai P.S. Case No. 133 of 2020 registered under Sections 341/323/376/504/506/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to earlier dispute. Further submission is that the informant of this case is in habit of making such false allegations. On perusal of Annexure-2, it appears that the father of the informant of the present case has also filed a case against the other accused persons, in which the accused persons were acquitted by the trial court giving benefit of doubt.

No.30239 of 2020(2) dt.05-03-2021 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, Gaya in connection with Khizersarai P.S. Case No. 133 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
