1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. The learned counsel for the petitioners submits that the petitioner no.1 has antecedent of one case and petitioner no.2 is a person with clean antecedent and is a woman and allegation against petitioner no.1 is of assaulting the informant (Santosh Chaudhary) by farsa causing injury on head while Keshwar Chaudhary and Sunil Chaudhary are alleged to have

Thereafter, Ramu Chaudhary and Shyamu Chaudhary assaulting his mother by lathi and danda causing fracture of hand and other accused also assaulted the father and mother of the informant.

The learned counsel for the petitioners submits that the injuries suffered by Santosh is simple in nature and as far as allegation against petitioner no.2 is concerned, the same is not specific and has been implicated only for the reason that she also belongs to the family of Surendra Chaudhary. It is further submitted that even petitioner and the informant are agnates and are having dispute relating to property.
5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2nd, Bagaha, West Champaran in
Patna High Court CR. MISC. No.33809 of 2024(3) dt.23-07-2024 3/3 connection with Laukariya P. S. Case No.103 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
