JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Earlier prayer for bail of the petitioner was allowed to be withdrawn vide order dated 13.08.2018 passed in Cr. Misc. No. 47111 of 2018 on the ground that the petitioner and others were arrested during pendency of the anticipatory bail petition. It has been submitted by learned counsel for the petitioner that under wrong impression the prayer for anticipatory bail of this petitioner and also the other petitioners of Cr. Misc No. 47111 of 2018 was withdrawn that they have been taken into custody, however, the present petitioner was not arrested at that time. So far allegation part is concerned, there is no allegation against the petitioner is of assaulting the informant and snatching golden chain.

No.53722 of 2018 (2) dt.05-09-2018 2/2 Having heard both sides, considering the fact and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather he should surrender and pray for regular bail, which will be considered on the basis of submission of learned counsel for the petitioner and the court below shall dispose of the prayer for bail of the petitioner, if possible, on same day, without being prejudiced by the order of this Court.
