The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.
The prosecution case, in short, is that in course of returning home, the informant was looted away Rs. 5,000/- by two unknown persons.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-02-2019. Charge sheet in this case has already been submitted. The petitioner is not named in the FIR. He has not been put on test identification parade. Rupees 5000/- is said to have been
Patna High Court CR. MISC. No.32245 of 2019(2) dt.16-05-2019 2/2 recovered from possession of the petitioner. It has further been submitted that the petitioner may be released after completion of six months in custody.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhagwanpur (Belaon) P.S.
