At the outset, the learned counsel for the petitioners submits that the petitioner no. 2 has already been apprehended by the Police, hence he is not pressing the bail petition qua the petitioner no. 2.
In such view of the matter, the bail petition as far as the petitioner no. 2 is concerned, is dismissed as not pressed. This is an application for grant of anticipatory bail in connection with Kursakanta P.S. Case No. 93 of 2018 registered for the offence punishable under Sections 341, 323, 354(B), 366A, 386, 504 and 506/34 of the Indian Penal Code. The allegation according to the victim girl is regarding
Patna High Court Cr.Misc. No.51641 of 2018 (2) dt.08-10-2018 2/3 the petitioners having kidnapped her and confined her to their house. However, when the parents and relatives of the victim girl had come there, she had gone back go her house. The learned counsel for the petitioners submits that there is no allegation of any untoward incident having been committed on the person of the victim girl as far as the petitioner no. 1 is concerned. It is further submitted that the petitioner is having a clean antecedent and is ready to abide by whatever conditions this Court may impose.
I have heard the learned counsel for the parties and I deem it fit and proper to enlarge the petitioner no. 1, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, on anticipatory bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Araria in connection with Kursakanta P.S. Case No. 93 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It is further directed that the petitioner would mark his attendance before the Officer In-Charge of the concerned Police Station at 10 A.M. on each Monday of the week and in the event of his failure on two consecutive defaults to mark his attendance,
Patna High Court Cr.Misc. No.51641 of 2018 (2) dt.08-10-2018 3/3 the present privilege of anticipatory bail shall stand cancelled automatically.
