JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-12-2021 At the outset, learned counsel for the petitioners seek permission to withdraw the application of petitioner nos. 2 & 4, namely, Vikash Kumar Singh @ Vikas Singh and Golu Singh as they have been arrested during the pendency of the application. Permission is granted.

Accordingly, the application as against the petitioner nos. 2 & 4 is dismissed as withdrawn.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Patna High Court CR. MISC. No.6603 of 2021(2) dt.02-12-2021 2/3 honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners are apprehending their arrest in connection with Sonpur P.S. Case No. 898 of 2018 for the offence registered under Sections 188, 143, 283, 353 and 341 of the Indian Penal Code.

The prosecution case in brief is that some persons including the petitioners had blocked the road at Bajrang Chowk causing severe inconvenience to the general travelers. On information, the policy party reached there and tried to convince the mob but they did not listen and intercepted the police officials and created hindrance while discharging their official duty.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in connection with the present case due to village politics. There is general and omnibus allegation against the petitioners. It is further submitted that the petitioners were not present in the mob and they have no criminal antecedent except the present one.

Considering the facts and circumstances of the case, let the petitioner nos. 1 & 3, above named, in the event of their arrest/surrender before the court below within a period of four

No.6603 of 2021(2) dt.02-12-2021 3/3 weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonpur P.S. Case No. 898 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
