For directing the respondent authorities to make payment of amount along with the interest deposited in the account of Late Reshma Devi, to the petitioner as he is the only legal heir of Late Reshma Devi.

ii. for any other relief/relief's to the petitioner as Your Lordship may deem fit and proper in the interest of justice."

Shri Prateek Kumar, learned counsel who appears on behalf of the respondent Bank, states that the petitioner is entitled for release of the amount, more so, in view of the Bank's decision of

Patna High Court CWJC No.13225 of 2021(3) dt.31-01-2022 2/2 the petitioner's entitlement thereto.

Statement accepted and taken on record.

Learned counsel further states that, if only the petitioner were to approach Respondent No.3, namely Branch Manager, Central Bank of India, Branch- Madarna, District- Vaishali, the application for release of the amount shall be processed immediately and the amount due and payable released immediately. Under these circumstances, petitioner shall make himself available in the office of Respondent No.3 on 15.02.2022 when Respondent No.3 shall process the petitioner's application immediately and shall release the amount of family pension of petitioner's mother forthwith.

Needless to add, petitioner shall place all documents, including the enquiry report annexed along with the rejoinder, before the said respondent.

Petition is disposed of in the aforesaid terms. Interlocutory application, if any, shall also stand disposed of.
