2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 396 and 397 of the Indian Penal Code and later on Section 412 IPC was added.

3. Earlier petitioner had moved for grant of regular bail and it was rejected vide order dated 17.01.2022 in Cr. Misc. No. 22752 of 2021 by another co-ordinate Bench of this Court. Second time, bail prayer of the petitioner was also rejected by this Court vide order dated 3.10.2023 passed in Cr. Misc. No. 63916 of 2022 with a direction to trial court to expedite and conclude the same within a period of six months, failing which

Patna High Court CR. MISC. No.33836 of 2024(2) dt.16-05-2024 2/2 petitioner was granted liberty to renew his prayer for bail.

4. It is submitted by learned counsel for the petitioner that there is no hope to conclude the trial in near future and petitioner is languishing in judicial custody since 27.08.2020.

5. From perusal of the impugned order dt. 16.4.2024, it appears that trial is running at the stage of adducing the prosecution evidence.

6. Having heard learned counsel for the parties and considering the period of custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Nawada in connection with Bundel Khand P.S. Case No. 711 of 2020.
