2. The petitioner seeks bail in Sindhugarh P.S. Case No. 12 of 2026 registered for the offences punishable under Sections 126(2), 115(1), 74, 75, 78, 108, 352, 351(2) and 3(5) of BNS, 2023.
3. The allegation is that one Mantu Kumar attempted to molest and rape the sister of the informant. She informed her family regarding the occurrence. She and her mother both came to their house and started pressurizing them not to lodge a case. While hot talks were going on, the brother of Sanoj Yadav namely Shivdhar Yadav started abusing his wife. On the commotion his sister went into severe stress and committed suicide.

4. Learned counsel for the petitioner submits that the crux of the allegation is against Sanoj Kumar and the allegation against the petitioner is of abusing wife of the informant. He further submits that the petitioner is in custody since 17.03.2026 and has no criminal antecedent.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering the indirect nature of allegation against the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - II, Sherghati, Gaya in connection with Sindhugarh P.S. Case No. 12 of 2026, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
9. It is made clear that any observation made herein is prima facie in nature and limited solely for
