The petitioner is apprehending his arrest in connection with Special (POCSO) Case No. 109 of 2018 for the offence registered under Sections 448, 506, 376/511 of the Indian Penal Code.

The allegation against the petitioner is that he entered into the house of the victim girl, who is a minor, while she was sleeping in her house and committed sexual offence against her. Learned counsel for the petitioner submits that it is a case of false implication and the petitioner has been implicated in the present case on account of dispute relating to sale and purchase of property.

Patna High Court CR. MISC. No.33140 of 2019(2) dt.20-05-2019 2/2 Considering the nature of allegation and also the first information report stands supported by the statement of the victim girl recorded under Section 164 Cr.P.C. as also the provision of POCSO Act, I am not inclined to grant pre-arrest bail to the petitioner.
