2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8(c), 21(b) N.D.P.S. Act and sections 109, 132, 1912), 190, 125 B.N.S.
3. The case of the prosecution, in short, is that altogether 6.48 grams of smack was recovered from the possession of the co-accused.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the allegation against the petitioner is that she attempted to facilitate the escape of the co-accused. It is further submitted that nothing has been recovered from the conscious possession of the
Patna High Court CR. MISC. No.30140 of 2026(2) dt.07-05-2026 2/2 petitioner. It is further submitted that the petitioner is a lady and has criminal antecedents in three cases, out of which one is of similar nature. Moreover, the petitioner is languishing in judicial custody since 18.03.2026.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Budha Colony P.S. Case No. 162/2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Session Judge/ Special Judge N.D.P.S Patna.
