Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Ekangarsarai P.S. Case No. 261 of 2020, disclosing offence punishable under Section 379 of the Indian Penal Code. The petitioner is in custody since 04.11.2020. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner was not named in the FIR and on the basis of confessional statement of a co-accused he came to be implicated on the allegation of stealing the motorcycle of the informant. He

Patna High Court CR. MISC. No.41029 of 2021(3) dt.05-01-2022 2/2 further submits that after petitioner's implication in the present case, he has been implicated in other criminal cases also. As the offence alleged against the petitioner constitutes offence under Section 379 of the IPC and the petitioner is in custody since 04.11.2020, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in Ekangarsarai P.S. Case No. 261 of 2020.
