2. The petitioner is apprehending his arrest in Motipur P.S. Case No. 149 of 2010 registered under Sections 409, 120(B) of the Indian Penal Code.

3. According to allegation, the petitioner did not submit the D.C. Bill and without submitting D.C. Bill, he was transferred to Batraun.

4. At the outset, it is submitted on behalf of the petitioner that at the relevant point of time, the petitioner was posted as Headmaster of Govt. Primary School, Morsandi (Girls), Motipur. It has further been submitted that the petitioner has

Patna High Court CR. MISC. No.32079 of 2025(6) dt.04-12-2025 2/2 already submitted all the D.C. Bills in 2011 but it was not reported to the concerned Block Education Officer and due to non-communication, he lodged the present F.I.R.

5. A report was called from from the Block Education Officer, Motipur, Muzaffarpur which has been received and from perusal of which, it appears that the petitioner has deposited all the D.C. Bills on 05-04-2011.

5. Learned APP has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Muzaffarpur,West in connection with Motipur P.S. Case No. 149 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of BNSS, 2023.
