JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
During course of argument, learned counsel for the petitioner has pointed out over age of the petitioner, presently shown as 19 years while, the occurrence has been alleged to have continued since last two years, that means to say petitioner was juvenile at an initial stage. It happens to be a continuing one and in the aforesaid background, the status of the petitioner is found duly protected under the guise of Juvenile Justice (Care and Protection of Children) Act. The learned Additional Public Prosecutor also fairly concedes so far disclosure of age of petitioner in the written report is concerned.
Patna High Court Cr.Misc. No.54002 of 2018 (2) dt.20-09-2018 Giving a liberty to be petitioner to raise such plea and if raised, the learned lower court will proceed with the same in accordance with law, the instant petition is disposed of in terms thereof.
