Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Mohammadpur P.S. Case No. 47 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

The petitioner is in custody since 02.03.2021. It is alleged in the First Information Report that about 110 liters of Indian Made Foreign Liquor was recovered from a tempo, which was intercepted by the police. One person had attempted to flee away from the tempo when the same was intercepted. The petitioner was, however, apprehended.

Be that as it may, considering the circumstance that the petitioner is in custody since 02.03.2021 and the chargesheet has been submitted, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Gopalganj, in Mohammadpur P.S. Case No. 47 of 2021.
