JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Brahmpur P.S. Case No.167 of 2020 for the offence under Sections 341, 323, 337, 504, 379 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 04.07.2020.

In the instant case, first information report was registered against four accused persons, who had illegally captured one room of the informant and when objected by the informant, they assaulted him. The allegation against the petitioner is that he assaulted the informant with lathi which

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No.167 of 2020.
