2. The petitioner is seeking regular bail in connection with Dagarua P.S. Case No. 52 of 2025 for the offences punishable under Sections 8(c)/21(c) of the NDPS Act,

3. As per allegation, 102.41 grams of smack was recovered from the possession of the petitioner, whereas 204.66 grams of smack was recovered from co-accused Sajan Kumar.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the quantity of smack recovered is less than the commercial quantity. The petitioner is a person of clean antecedents and is under custody since 12.02.2025.

5. Learned APP for the State has opposed the prayer

Patna High Court CR. MISC. No.30577 of 2025(2) dt.16-05-2025 2/2 for bail.

6. The petitioner was arrested at the spot and smack was recovered from his possession.

7 Considering the above-mentioned facts and circumstances, I do not think it to be a fit case for bail, which is hereby rejected.
