Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 323/307/149 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Petitioner and other accused persons are alleged to have assaulted the informant. Accused persons also resorted to indiscriminate firing.

Learned counsel appearing for the petitioners submits that there is general and omnibus allegation of resorting to firing and assault against all the accused persons and no specific overt

Patna High Court CR. MISC. No.31791 of 2022(2) dt.10-10-2022 2/2 act has been alleged against the petitioners. There is no fire arms injury to the informant side. Injuries sustained by the injured have been found to be simple in nature. Petitioners have got no criminal antecedent.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate V, Bhojpur at Ara in Bihiya Police Station Case No. 372 of 2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
