JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 06-10-2018 Heard Mr. N.K.Agrawal, learned Senior Advocate for the petitioners and Mr. Chandrasen Prasad Singh, learned Additional Public Prosecutor for the State.

The petitioners seek pre-arrest bail in connection with Sakara P.S. Case No.508 of 2017 registered under Section 409 read with Section 34 of the Indian Penal Code. Regard being had to the specific allegation made in the first information report that the petitioners being Panchayat Secretary and Mukhiya of Gram Panchayat, Rupan Patti, Mathura defalcated Rs.12,10,764/- which was taken by them for execution of different works in the Panchayat, I am not inclined to grant

Patna High Court Cr.Misc. No.56910 of 2018 (2) dt.06-10-2018 2/2 them pre-arrest bail.

Accordingly, the application for grant of pre-arrest bail to the petitioners is dismissed.

In case the petitioners surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
