11-09-2018 Heard Dr. Leelawati Kumari, learned counsel for the petitioner and Sri Rajendra Prasad Nat, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Madanpur P.S. Case No. 117 of 2018 registered for offence under Sections 328, 308 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner, by way of drawing my attention to the F.I.R., submits that it appears that it was an accident, in which, colour has been given, as if, petitioner has committed offence under Section 308 of the Indian Penal Code. Learned Addl. Public Prosecutor has opposed the prayer.
However, after going through the F.I.R., I am of the
Patna High Court Cr.Misc. No.54067 of 2018(2) dt.11-09-2018 2/2 opinion that it is a fit case for extending the privilege of anticipatory bail.
Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Upendra Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Madanpur P.S. Case No. 117 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
