The petitioner, in the present case, is seeking anticipatory bail in connection with Bihra P.S. Case No. 26 of 2018, registered for offences alleged under Sections 411, 413 and 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that so far as the present petitioner is concerned, he was not arrested by police on spot. Name of this petitioner transpired in the confessional statement of the apprehended accused. It is submitted that although the allegation is that the accused persons are running a gang involved in illegal selling of stolen motorcycle but the fact remains that this petitioner has got no criminal antecedent and
Patna High Court Cr.Misc. No.54461 of 2018 (2) dt.08-10-2018 2/2 nothing has been recovered from his possession. No one appears on behalf of the State to oppose this application.
Considering the facts and circumstances of the case, wherein it is submitted that the petitioner has got no criminal antecedent and there is no recovery of any stolen motorcycle, in case of his arrest within four weeks, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 26 of 2018, subject to the conditions U/S 438(2) Cr.P.C.
