The Registry shall be vigilant in placing the case diary etc. on the record soon after receipt of the same. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

Petitioners are relations of co-accused-Santosh

Patna High Court CR. MISC. No.25784 of 2020(4) dt.12-01-2021 2/3 Kumar who is already in custody. Wife of Santosh Kumar died in unnatural circumstances and there is general and omnibus allegation of demand of dowry and torture for the same against all the inlaws.

Learned counsel for the petitioners submits that after giving birth to two children, the victim died and till before her death, there is no material that there was any complain of demand of dowry and torture for the same. Petitioners are victim of over implication. Most of the petitioners are females and one of the petitioners is aged about 60 years.

Considering the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Rajgir P.S.Case No. 461 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate

Patna High Court CR. MISC. No.25784 of 2020(4) dt.12-01-2021 3/3 with the investigation/trial of the case and also the petitioners shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
