Petitioner apprehends arrest in connection with Complaint Case No. 1367 of 2019 registered for the offence under sections 323, 498A of the Indian Penal Code and sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that petitioner undertakes to make payment of the ad-interim maintenance amount regularly in compliance of the order dated 18.07.2022 passed in Matrimonial Case No. 402 of 2019 and petitioner has already deposited Rs. 21000/- in the account of the opposite party no. 2 on 10.02.2023, as stated in paragraphs 3

Patna High Court CR. MISC. No.31365 of 2022(4) dt.26-04-2023 2/2 and 4 of the supplementary affidavit filed on behalf of the petitioner.

Considering the facts and circumstances of the case, the submissions advanced on behalf of the parties and the undertaking given by the petitioner, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Sub Divisional Judicial Magistrate, Nawada in connection with Complaint Case No. 1367 of 2019 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
