2. The petitioner is apprehending arrest in connection with Batia P.S. Case No. 65 of 2024, dated 05.09.2024, lodged under Section 80(2), 103(1), 61(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023").

3. As per the prosecution, FIR has been lodged against four named accused persons, including the present petitioner, alleging that they killed the informant's daughter over a demand for dowry of 5,00,000/- (Rupees Five Lakh), in spite of the ₹ fact that panchayats have taken place several times regarding this matter.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner is the father-in-law of the

Patna High Court CR. MISC. No.32164 of 2025(2) dt.15-05-2025 2/2 deceased and is an elderly person, aged about 65 years. It is also submitted that the husband of the deceased has already been in custody since 18.09.2024, and the petitioner has been unnecessarily made an accused in the present case. Counsel further submits that the petitioner has clean criminal antecedents and is ready to comply with any condition that may be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 6 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate, Jamui, in connection with Batia P.S. Case No. 65 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
