JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-07-2019 In compliance of the earlier order of this Court dated 17.07.2019, a supplementary counter affidavit has been filed on behalf of the respondent no.4 wherein it has been stated that the special/ extraordinary pension, as permitted according to the Government resolution, has already been paid to the petitioner and as regards the revised family pension, it is submitted that the office of the Accountant General, Bihar, Patna has already been requested to re-fix the same in light of the 7th Pay Revision Commission report, vide letter dated 24.07.2019 written by the Superintendent of Police, West Champaran at Bettiah.

Patna High Court CWJC No.4974 of 2017(5) dt.31-07-2019 2/2 In such view of the matter, this Court is of the view that the present writ petition does not require to be proceeded with further, however, a direction is issued to the Accountant General, Bihar, Patna to ensure re-fixation of the family pension of the petitioner within a period of four weeks from today, whereafter the same shall be paid to the petitioner along with arrears by the Treasury Officer, Sasaram within a period of four weeks thereafter, failing which both the said officers shall not draw their salary.

The present writ petition stands disposed of with the aforesaid directions.
