JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2020 Heard Mr. Anish Chandra, learned counsel for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with C2A Case No. 65 of 2019, dated 28.05.2020, instituted for the offences under Sections 30(k) (gh) and 36 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The petitioners are said to have run away from the place where the raid was conducted and liquor was recovered.

It has been submitted on behalf of the petitioners

Patna High Court CR. MISC. No.30361 of 2020(2) dt.18-12-2020 2/2 that there is no recovery from the possession of the petitioners and they are persons of clean antecedent. Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-CumSpecial Judge (Excise Act), Vaishali at Hajipur, in connection with C2A Case No. 65 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
