Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be wife of the deceased and allegedly she had illicit relation with one Kamlesh Kumar and it appears that except the aforesaid accusation, there is nothing against the petitioner. The FSL report reveals that thymate was found in the viscera of the deceased. So it appears that the deceased consumed poison. Although, the police submitted charge sheet under Sections 328, 302/34 of the Indian Penal Code but except the above stated circumstantial evidence, there appears to be nothing against the petitioner.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.9771 of 2014 (7) dt.23-03-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 6th Additional Sessions Judge, Muzaffarpur in connection with Sakra P.S. Case No. 162 of 2012 corresponding to Sessions Trial No. 713 of 2012.
The office should send the FSL report to concerned court under sealed cover forthwith.
