ANSHUMAN ORAL ORDER 17-03-2023 Heard learned counsel for the petitioner, learned counsel for the Opposite Party and learned counsel for the State. Counsel for the petitioner submits that he has filed a supplementary counter affidavit in this case, by which he wants to show and bring before the Court that O.P. No. 2 has filed many cases against the petitioner in different courts with sole motive to harass and extort money by putting pressure on the petitioner. He submits that in Matrimonial Divorce Case No. 1087 of 2015, Domestic Violence Case No. 103 of 2015 and petition for restoration of Conjugal life have been filed by the petitioner, whose case no. has not been mentioned in the petition.

Counsel for the O.P. No. 2 submits that the present Cr.

Patna High Court CR. REV. No.387 of 2022(8) dt.17-03-2023 2/2 Revision has been filed against the order passed by the Appellant Court under Domestic Violence Act. He further submits that vide order dated 31.08.2022, there was a categorical direction that on the said date the liability upon the petition was of payment of Rs. 4,20,000/- and the Court has directed him to make payment of Rs. 1,00,000/- and remaining 3,20,000/- in 12 equal installments. Then the matter has been referred before mediation for amicable settlement of dispute. Counsel for the petitioner submits that the mediation could not take place successfully but the petitioner has also not complied the order passed by this Hon'ble Court dated 31.08.2022. He has paid only Rs. 1,00,000/- but not a single payment has been made towards installment amount, which he ought to pay in 12 equal installments.

In this view of the matter, petitioner has not bayed/ obeyed the undertaking made before this Court, therefore, this Court is not inclined to entertain this Cr. Revision application, therefore, the present Cr. Revision is hereby dismissed. (Dr. Anshuman, J.) ashishsingh/- U T
