2. The petitioners apprehend their arrest in connection with Siwan Muffasil P.S. Case No. 752 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 109, 3/5 of BNS.

3. On the fateful day, while the informant was sitting at his door, in the meanwhile, all the petitioners by making unlawful assembly reached there and started assaulting the informant. It is specifically alleged that the petitioner no. 1 assaulted the informant with dab over his head. So far petitioner

Patna High Court CR. MISC. No.30945 of 2025(2) dt.19-05-2025 2/3 no. 2 is concerned, he also assaulted the informant with lathi whereas petitioner nos. 3 and 4 allegedly assaulted the informant by means of lathi and iron rod.

4. Learned Advocate for the petitioners contended that the present case is nothing but a counter blast to Barharia P.S. Case No. 747 of 2024 instituted by the petitioner no. 1. So far the injuries sustained to the informant are concerned, all of them have been found to be simple in nature, except one which has sustained over his head. It is also the contention of the petitioners that the present FIR came to be lodged in the backdrop of long standing dispute. The petitioners are men of fair antecedent and they undertake before this Court that they will fully cooperate in the investigation and the proceeding of the court.

5. On the other hand, learned Advocate for the State vehemently opposes the bail application and submits that because of assault made by the petitioners, the informant has sustained serious injuries.

6. Regard being had to the submissions made on behalf of the parties and considering the case and counter case, coupled with the fair antecedent and the nature of injuries, which have been found to be simple in nature except one, let the

No.30945 of 2025(2) dt.19-05-2025 3/3 petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S. Case No. 752 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
