1. Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 304 (B), 34 of the Indian Penal Code.
3. It is a case of dowry death.
4. Petitioner nos. 1 and 2 are brothers-in-law of the victim (deceased).
5. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of
Patna High Court CR. MISC. No.35534 of 2023(2) dt.21-07-2023 2/2 the deceased who is already in custody.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa, Nalanda in connection with Hilsa P.S. Case No. 174 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
