The petitioner apprehends his arrest in Ladania P.S. Case No.135 of 2016 registered under Sections 409 and 420 of the Indian Penal Code.

Sanjay Singh, the then Branch Manager of Punjab National Bank of Ladania Branch alleged that Sanjay Kumar, Head Cashier of Punjab National Bank, Ladania Branch committed different irregularities and debited the accounts of customers, Govt. accounts and also made interpolation in different bills and defalcated about Rs.55,33,901/- but he deposited only Rs.2,30,000/-.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.29846 of 2019(2) dt.07-05-2019 2/3 petitioner was Branch Manager of Punjab National Bank, Ladania Branch. None of the Branch Managers is made accused in the case. During the course of investigation, the petitioner and other Branch Managers were made accused only on the basis of the fact that during tenure of the petitioner and other Branch Managers, Sanjay Kumar, Head Cashier of the Branch after making interpolation of different records, accounts, bills of Punjab National Bank, Ladania Branch credited more than Rs.55 lacs in his account or in the account of his wife and other relatives and on such, the petitioner and Ramjiwan Chaudhary, Subh Narayan Yadav and Shivnandan were made accused.

It is further submitted that Ramjiwan Chaudhary, Subh Narayan Yadav and Shiva Nand have already been granted anticipatory bail by this Court in Cr. Misc. No.70275 of 2018, Cr. Misc. No.70999 of 2018 and Cr. Misc. No.78957 of 2018. Learned counsel appearing on behalf of Punjab National Bank did not controvert these facts.

Patna High Court CR. MISC. No.29846 of 2019(2) dt.07-05-2019 3/3 names also surfaced during the course of investigation have already been granted bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IV, Madhubani/Incharge Successor Court in connection with Ladania P.S. Case No.135 of 2016, G.R.
