1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Sultanganj Police Station Case No. 453 of 2024, dated 21.10.2024, disclosing offences under Sections 318(4)/115(2)/351(2)/352/74/308(3) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, as per the First Information Report, is that the informant was working in a private school and in the same school, the petitioner was also working. During the Covid-19 period, the petitioner exploited the informant physically, mentally and economically.

The petitioner gave false promise of marriage and exploited the informant and now he is intending to perform marriage with another girl. The petitioner abused and assaulted the informant on 24.07.2024 and 25.08.2024.

Learned counsel for the petitioner submits that the petitioner has not committed any offenc in the manner alleged and as per the First Information Report, the relationship between the petitioner and the informant continued for about five years, which goes to show that the relationship was consensual in nature. He next submits that the informant in her affidavit has declared that she has received the jewelry and cash from the petitioner and now she has no grievance against him. He further submits that the affidavit of the informant is annexed at Annexure-P/2 to the application.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the relationship continued for about five years and the informant is matured lady having two children and must be understanding repercussion of her relation with the

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna City, in connection with Sultanganj Police Station Case No. 453 of 2024, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
