Petitioner seeks regular bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have caused fire arm injury to brother of informant and covillager, Ram Khelawan Singh. Learned counsel appearing for the petitioner submits that though petitioner is named in the FIR but the police after investigation did not sent up him for trial and the learned court below after differing with the finding of I.O. has taken cognizance against this petitioner. Petitioner is in custody since

Patna High Court CR. MISC. No.41238 of 2021(4) dt.07-01-2022 2/2 04.04.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-X, Aurangabad in connection with Kutumba PS case No.44/1987.
