JUSTICE BIRENDRA KUMAR ORAL ORDER 25-10-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in connection with Desari (Chandpur O.P.) P.S. Case No.102 of 2018, registered for the offences punishable under Sections 341/323/324/325/307/379/504/34 of the Indian Penal Code. There is case and counter case. Petitioner Suresh Rai allegedly caused injury with farsa at the head of the nephew of the informant and petitioner Awdhesh Rai caused three fracture injuries on different parts of the body.
Considering the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Hence, the prayer for anticipatory bail is refused.
