The petitioner apprehends his arrest in Halsi P.S. Case No.75 of 2020 registered under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and section 37(b)(c) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to political rivalry and old enmity. He also submits that there is general and omnibus allegation against the petitioner. The petitioner has got no criminal antecedent.

Learned A.P.P. for the State has opposed the prayer for bail by contending that the petitioner and another accused in inebriated condition came and started assaulting the informant as a result of which the informant sustained injuries. The

Patna High Court CR. MISC. No.41321 of 2021(4) dt.10-05-2022 2/2 petitioner is also alleged to have taken Rs.10,000/- from the shop of the informant. Therefore, the petitioner does not deserve anticipatory bail.

Having considered the facts aforesaid, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for bail is rejected. (Arvind Srivastava, J) Harish/- U T
