2. The petitioner is in custody in connection with Sonbarsa P.S. Case No. 359 of 2024 for the offence punishable under Sections 8, 20(B), (ii) (c) and 22 of the NDPS Act lodged on 14.11.2024 by the informant, Devendra Chaudhary.

3. As per the prosecution story, the informant alleged that on secret information about the accused persons selling 'charas' after bringing it from Nepal, the house was raided and 1.25 kg 'charas' recovered/seized. This led to the FIR.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated only because he has criminal antecedents.

5. Learned APP on the other hand opposes the prayer

Patna High Court CR. MISC. No.30109 of 2025(3) dt.06-08-2025 2/2 for bail submitting that not only he has criminal antecedents, the recovered material is much above the commercial quantity.

6. Taking into account the submission of the parties as also the fact that the recovered material is much above the commercial quantity, in that background, this Court is not inclined to extend him the privilege of bail.

7. The bail application stands rejected.

8. However, as the petitioner is in custody since 15.11.2024, it is expected that the Trial Court will be speeding up the trial so that it comes to an end at an earliest. (Rajiv Roy, J) Adnan/- U T
