JUSTICE MADHURESH PRASAD ORAL ORDER 08-01-2019 It is submitted on behalf of learned counsel for the State referring to the averments made in paragraphs 10 and 11 of the counter affidavit that respondents have already redressed claim of the petitioner in so far as it relates to arrears on account of salary and post retiral dues. Learned counsel for the State has also pointed out with reference to the aforesaid paragraphs of the counter affidavit that arrears on account of revision as per 6th Pay Commission Recommendation is likely to be paid to the petitioner very soon. So far as claim of Assured Career Progression (ACP)/Modified Assured Career Progression (MACP) is concerned, it has been stated that the matter has already been placed before the Superintending Engineer,

Patna High Court CWJC No.1048 of 2015(3) dt.08-01-2019 2/2 Darbhanga, for a final decision.

In view of the such action having been taken, no useful purpose would be served by keeping the writ petition pending as final steps in the matter have to be taken by the authorities in light of averments made in the counter affidavit in respect of petitioner's claim for benefits of 6th Pay Commission's recommendation and ACP/MACP expeditiously and without undue delay.

The petitioner would be at liberty to approach the authorities.

The writ petition is disposed of.
