2. The present writ petition has been filed for challenging the order passed by the District Magistrate vide Memo No. 1556(East), dated 19.09.2016.

3. Learned Counsel for the State raised preliminary objection and submits that the petitioner has filed the writ petition, challenging the order of the Collector, directly before this Hon'ble Court without challenging the said order before the Commissioner.

4. In this background, the present writ petition stands disposed off granting liberty to the petitioner to avail the remedy

Patna High Court CWJC No.4645 of 2017(4) dt.03-04-2025 2/2 before the Commissioner, Magadh Division within 30 days from the date of publication of the order.

5. The Commissioner, Magadh Division, is directed to pass the order within 90 days after the appearance of all concerned parties.
