Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 1.10.2018 passed in Cr. Misc. No.51215 of 2017 and there is direct allegation of firing on the deceased causing his death and taking away Rs.02 lac. Submission of the learned counsel for the petitioner is that he is in custody since 21.10.2016 in spite of that up till now the case has not been committed.

Heard learned A.P.P. also.

Having heard both sides and in view of the allegation, I am not inclined to grant bail to the petitioner, however, learned court below is directed to expedite the commitment and even if it requires to separate the case of the petitioner from the other accused persons as he is in custody for

Patna High Court CR. MISC. No.37428 of 2019(3) dt.04-07-2019 2/2 more than 2 1⁄2 years.

Accordingly, this application is dismissed.
